Terms of Service (Velocity Hosting)
These Terms of Service (“Terms”) govern access to and use of services provided by VelocityServers Ltd (“Velocity”, “we”, “us”, “our”). By ordering, using, or accessing our services, you (“Customer”, “you”) agree to these Terms.

2) Definitions

Services: Hosting, server, networking, storage, and related services we provide (as described on our website/order form).

Order: Your purchase, subscription, or renewal of Services.

Content: Data, files, software, websites, emails, and other materials stored, processed, or transmitted using Services.

Acceptable Use Policy (AUP): The rules in Section 7.
3) Account, eligibility, and accuracy
You must provide accurate account, billing, and contact details and keep them current. You are responsible for all activity under your account, including actions by users you authorise. We may require identity/business verification to comply with legal and risk obligations.
4) Service provisioning and changes
We will use reasonable skill and care to provide Services. We may update, modify, or replace features to maintain security, performance, or compliance. If a change materially reduces core functionality of a paid Service, we will provide reasonable notice where practicable.
5) Fees, billing, taxes, and payment

Fees are as stated at checkout or your Order.

Billing cycle: Services are billed in advance unless stated otherwise.

You authorise us (and our payment processors) to charge fees, taxes, and applicable surcharges.

If payment is overdue, we may suspend Services, restrict access, or terminate under Section 12.

You are responsible for all applicable taxes (including VAT if/when applicable). If VAT is chargeable, a VAT invoice will be provided.
6) Renewals
Subscriptions may renew automatically unless cancelled before the renewal date. You are responsible for maintaining valid payment details. If renewal payment fails, we may suspend Services after notice (where practicable).
7) Acceptable Use Policy (AUP)
You must not use Services to:

violate any law or regulation (including UK and applicable international laws);
-
distribute malware, run botnets, or engage in unauthorised access/scanning;
-
send unsolicited bulk email (“spam”), operate open relays, or undertake deceptive messaging;
-
host or distribute child sexual abuse material, terrorist content, or content inciting violence;
-
infringe intellectual property rights;
-
facilitate fraud, phishing, or illegal gambling/financial crime;
-
overload or disrupt our systems or third-party networks (including DDoS participation).
We may suspend or terminate Services immediately where we reasonably believe there is a security risk, legal risk, or AUP breach.
8) Security and your responsibilities
You are responsible for securing your applications, credentials, and Content, including:
-
keeping software updated, using strong passwords/MFA where available;
-
maintaining backups (even if you purchase backup options—see Section 10);
-
complying with secure configuration and access control best practices.
9) IP addresses, networking, and abuse handling
IP addresses assigned remain our (or our upstream provider’s) property and may be changed. We may null-route or mitigate traffic during attacks or abuse events to protect network stability.
10) Backups, data integrity, and restoration
Unless explicitly included in your Order, backups are not guaranteed. Where backup/restore is provided, it is best-efforts and may have limitations (retention windows, exclusions, restoration time). You remain responsible for independent backups.
11) Support
Support channels and hours are described on our site. We may prioritise incidents by severity and may require your cooperation (logs, access, change approvals) to investigate.
12) Suspension and termination
We may suspend or terminate Services if:
-
fees remain unpaid after due date;
-
you breach the AUP or these Terms;
-
required verification is not provided;
-
we must do so to comply with law, court order, or regulator request; or
-
continued provision would create material security or operational risk.
You may cancel by following the account cancellation process. Cancellation stops renewal; fees paid are handled per the Refund Policy.
13) Content and intellectual property
You retain rights to your Content. You grant us a limited licence to host, process, and transmit Content solely to provide the Services. We own all IP in our platform, branding, and documentation.
14) Third-party services and data centres
We may rely on third-party providers (e.g., data centres, network carriers, cloud infrastructure, payment processors). Your use may be subject to third-party terms. We are not responsible for third-party outages beyond our reasonable control, but we will use reasonable efforts to restore Services.
15) Compliance, law enforcement, and disclosures
We may preserve or disclose information where required by law, subpoena, court order, or to protect rights, safety, and security, including prevention of fraud and abuse.
16) Warranties and disclaimers
To the maximum extent permitted by law, Services are provided “as is” and “as available”. We do not warrant uninterrupted, error-free operation or that Services will meet every requirement. Nothing excludes liability for death/personal injury caused by negligence, fraud, or other liabilities that cannot be excluded under UK law.
17) Limitation of liability
To the maximum extent permitted by law:

We are not liable for indirect, consequential, special, or punitive losses (including loss of profits, revenue, goodwill, data, or business interruption).

Our total aggregate liability under these Terms in any 12-month period is limited to the fees paid by you for the affected Services in the 12 months immediately preceding the event giving rise to the claim.
18) Indemnity
You will indemnify and hold us harmless against claims arising from your Content, your use of Services, or breach of these Terms/AUP, including reasonable legal fees.
19) Consumer rights (if you are a consumer)
If you are a UK consumer, statutory rights apply (including under the Consumer Rights Act 2015). Business customers acknowledge that consumer protections may not apply.
20) Governing law and jurisdiction
These Terms are governed by the laws of England and Wales. Courts of England and Wales have exclusive jurisdiction, except where consumer law provides otherwise.
21) Changes to these Terms
We may update these Terms. If changes are material, we will provide reasonable notice (e.g., by posting and/or email). Continued use after the effective date constitutes acceptance.
